SUBJECT:  Model Local Interagency Agreement for Responding to Reports of Child Abuse and Neglect

The purpose of this memo is to share the model local agreement between school divisions and local departments of social services for coordinating the response to reports of child abuse and neglect (see Attachment A).  This model agreement has been developed collaboratively by the Virginia Department of Education (VDOE) and the Virginia Department of Social Services (VDSS), with participation from representatives from school divisions and local departments of social services.

The 2014 Virginia General Assembly approved HB 683 that amends § 63.2-1511 of the Code of Virginia to read,

(D) “Each local department and local school division shall adopt a written interagency agreement as a protocol for investigating child abuse and neglect reports against school personnel. The interagency agreement shall be based on recommended procedures for conducting investigations developed by the Departments of Education and Social Services.”

HB 683 also requires school divisions to report annually to the Board of Education regarding the status of interagency agreements until they are adopted.  Thereafter, school divisions are required to report to the Board of Education when their interagency agreement has been substantially modified.  To comply with this requirement, school divisions must send a copy of their interagency agreement with the local department of social services (signed by both parties) to Maribel Saimre via e-mail at
